Labour Market Impact Assessment

An employer in Canada may be required to obtain a Labour Market Impact Assessment before recruiting a foreign worker. Before filing for a work visa, a Canadian employer must first decide whether an LMIA is required or if the position is exempt from the requirement.

Under the eight (8) primary streams, Canadian firms can file for a Labour Market Impact Assessment (LMIA) to hire a foreign worker. It is critical to choose the right type of LMIA. In fact, it will determine which conditions must be met, such as an employer’s eligibility, job postings, and which application forms must be completed.

Low-Wage LMIA

If a foreign worker’s compensation is less than the provincial or territorial median hourly wage.

High-Wage LMIA

A temporary worker’s hourly compensation is equal to or higher than the provincial or territorial median hourly rate.

LMIA for Agricultural Workers

Only hire foreign workers for primary agriculture activities on the farm (find below the list of all eligible commodity sectors).

LMIA for Seasonal Agricultural Workers

To employ individuals from designated nations to do primary agriculture activities on the farm (find below the list of all participating countries and eligible commodity sectors).

LMIA to Support a Permanent Residency (PR) Visa Application

Only for high-wage positions in the National Occupational Classification’s Skill Type and Level A and B. (NOC).

Dual Intent LMIA

It serves two purposes: it assists with both PR and work permit applications.

LMIA for Global Talent Stream

Under this stream, 1) innovative organizations in Canada can hire unique and specialised foreign nationals referred by designated referral partners, or 2) Canadian companies can hire for in-demand highly-skilled professions included on the Global Talent Occupations List.

LMIA for In-home Caregivers

In the private household, Canadians can hire foreign caregivers to care for children, seniors, or those with documented medical requirements. The list of qualifying caregiver employment under this LMIA stream can be found below.
